1. Overview and Acceptance

These Terms of Use ("Terms") constitute a legal agreement governing your use of the PortreStudio mobile application ("App"). By downloading, installing, or continuing to use the App, you represent that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

2. Description of Service

PortreStudio is an iOS application that enables users to generate new images from portrait photos they upload, using artificial intelligence technology. The App operates on a credit-based system and provides the following core features:

  • Uploading a source portrait photo
  • AI-powered photo generation
  • Viewing and saving generated images to the device
  • Acquiring credits through in-app purchases

The service depends on third-party infrastructure providers (Supabase, Cloudflare R2, Fal.ai, RevenueCat). PortreStudio cannot be held responsible for interruptions or service changes caused by these providers.

3. Account Creation and Eligibility

3.1 Age Requirement

You must be at least 13 years old to use the App. Users under the age of 18 are advised to use the App only under the supervision of a parent or legal guardian.

3.2 Account Security

You are responsible for the security of your account. You must not share your login credentials with third parties. You must contact us immediately if you become aware of any unauthorized use of your account. PortreStudio cannot be held responsible for damages resulting from unauthorized access.

3.3 One Account Per Person

Accounts are personal and non-transferable. Creating multiple accounts for a single person is prohibited.

4. Credits and Payments

4.1 Credit System

Photo generation is performed using credits purchased in advance. Each generation job deducts a specified number of credits from your account. Credit amounts are indicated within the App.

4.2 Purchasing

Credit packages are acquired through in-app purchases (IAP) via the Apple App Store. All payment transactions are managed by Apple and RevenueCat infrastructure.

4.3 Refund Policy

Purchased credits are non-refundable, whether used or unused. For in-app purchase refunds, Apple's refund policy applies. You may submit refund requests through Apple's support page: support.apple.com

4.4 Credit Validity

Credits remain valid as long as your account is active. In the event of account deletion, unused credits are also deleted and are not refunded.

4.5 Price Changes

PortreStudio reserves the right to change credit package pricing with prior notice.

5. User Content

5.1 Content Responsibility

You bear full legal responsibility for the photos you upload to the App. You represent and warrant that the images you upload:

  • Are owned by you or that you hold the necessary permissions,
  • Do not violate the privacy rights of others,
  • Do not infringe any copyright or other intellectual property rights.

5.2 License

By uploading content to the App, you grant us a limited, non-exclusive, and non-transferable license to process that content (upload to cloud storage, send to the AI model, generate results) for the purpose of operating the service. This license is used solely for the operation of the service.

5.3 Generated Images

Images generated by the AI belong to you. PortreStudio does not claim any ownership rights over generated images.

6. Prohibited Uses

The following uses are strictly prohibited:

  • Uploading or processing another person's photo without their consent
  • Generating content involving images of minors
  • Generating sexual, obscene, or pornographic content
  • Generating content containing hate speech, violence, or discrimination
  • Generating deceptive images (deepfakes) that misrepresent real individuals
  • Using the App for fraud, identity theft, or any other illegal purpose
  • Attempting to damage, overload, or gain unauthorized access to the App's infrastructure
  • Sending bulk requests through automated tools (bots, scripts, etc.)
  • Attempting to reverse engineer any component of the App

Accounts that violate these terms may be permanently closed without prior notice.

7. Intellectual Property

7.1 The App

The App itself, its design, code, interface, logo, and all other components are the property of PortreStudio and are protected by intellectual property laws. Copying, modifying, distributing, or creating derivative works from the App is prohibited.

7.2 Third-Party Technologies

The App uses various third-party technologies, including AI models provided by Fal.ai. These technologies are subject to their own license terms.

8. Disclaimers and Limitation of Liability

8.1 Service Provided "As Is"

The App is provided "as is" without any express or implied warranties. There is no guarantee that the service will operate continuously, without errors, or at any particular level of quality.

8.2 AI Outputs

Images generated by AI are non-deterministic; different results may be produced from the same inputs. PortreStudio does not guarantee the quality, accuracy, or fitness for any particular purpose of generated images. Credits spent on a generation job that fails or does not meet expectations are non-refundable.

8.3 Limitation of Liability

PortreStudio's total liability to a user under any circumstances is limited to the total amount paid by that user to PortreStudio in the preceding 12 months.

9. Suspension and Termination

9.1 Termination by User

You may delete your account at any time through the in-app settings or by contacting us.

9.2 Termination by PortreStudio

We may suspend or permanently close your account without prior notice in the following circumstances:

  • Violation of these Terms
  • Actions that breach applicable laws or regulations
  • Activities that harm other users or the system
  • Prolonged inactivity

9.3 Effect of Termination

Unused credits are non-refundable upon account termination.

10. Changes

We may update these Terms from time to time. Users will be notified of significant changes via in-app notification or email. Continued use of the App after the effective date of a change constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of Turkey. The courts of Turkey have jurisdiction over any disputes arising from these Terms.
